Welcome to PilotDate, the exclusive dating platform for verified pilots and aviation professionals. By accessing or using our services, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

If you do not agree to these Terms, you may not use PilotDate.

1. Eligibility Requirements

To use PilotDate, you must:

1. Be at least 18 years of age
2. Be legally permitted to use dating services in your jurisdiction
3. Not be prohibited from using our service by any applicable law
4. Not have been previously banned or suspended from PilotDate
5. Have a valid email address
6. Agree to verify your identity and pilot credentials (for full access)
7. Comply with all applicable federal, state, and local laws

Verification Requirements

While anyone 18+ can browse, full platform access requires verification as a pilot or aviation professional:

• Upload a government-issued ID (Driver's License or Passport) for age verification
• Upload your Pilot's License or FAA Certificate for aviation credential verification
• Provide a valid FAA Certificate Number (publicly searchable on FAA.gov)

2. Account Registration & Verification

Account Security

• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your password
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized access or security breach
• You may not transfer or sell your account to another person
• You may only create ONE account per person

Profile Accuracy

You agree that:

• Your profile information is truthful and accurate
• Your photos are current (within the last year) and actually depict you
• You will not impersonate any person or entity
• You will update your profile if your aviation credentials change
• You will not create fake or misleading profiles

3. Acceptable Use Policy

PilotDate is designed to help pilots connect for dating and relationships. You agree to use the service only for its intended purpose.

You MAY:

• ✅ Create an honest profile representing yourself
• ✅ Browse and match with other verified pilots
• ✅ Send respectful messages to your matches
• ✅ Share aviation stories, experiences, and photos
• ✅ Arrange to meet matches in safe, public places
• ✅ Report suspicious or inappropriate behavior
• ✅ Use premium features if you have a paid subscription

You MAY NOT:

• ❌ Use the service for commercial purposes or advertising
• ❌ Send spam, solicitations, or marketing messages
• ❌ Promote businesses, services, or third-party websites
• ❌ Use automated tools, bots, or scrapers
• ❌ Attempt to access other users' accounts
• ❌ Reverse engineer or copy our platform
• ❌ Collect user data for any purpose

4. Prohibited Conduct

• Harassment or Abuse: Bullying, stalking, threatening, or harassing other users
• Sexual Harassment: Unwanted sexual advances, explicit messages, or inappropriate content
• Hate Speech: Content promoting discrimination based on race, religion, gender, sexual orientation, disability, etc.
• Violence: Threatening or promoting violence against any person or group
• Illegal Activity: Drug sales, prostitution, trafficking, or any illegal activity
• Financial Scams: Asking for money, promoting investment schemes, or financial fraud
• Minors: Any content involving minors or attempts to contact minors
• Revenge Porn: Sharing intimate images without consent
• Catfishing: Using fake photos or impersonating someone else
• Spam/Solicitation: Mass messaging, pyramid schemes, or commercial solicitation
• Account Manipulation: Creating multiple accounts, vote manipulation, or review fraud
• Privacy Violations: Sharing others' private information without consent (doxxing)

5. User Content & Intellectual Property

Your Content

You retain ownership of any content you post on PilotDate (photos, messages, bio, etc.). However, by posting content, you grant PilotDate a worldwide, non-exclusive, royalty-free license to:

• Display your content to other users
• Store and back up your content
• Use your content for platform improvement and analytics (anonymized)
• Use your content in marketing materials (only with your explicit consent)

Content Guidelines

All content you post must:

• Be created or owned by you
• Not violate any copyright, trademark, or intellectual property rights
• Not contain malware, viruses, or harmful code
• Be appropriate for a dating platform (no pornography or graphic violence)
• Comply with all applicable laws

Our Intellectual Property

The PilotDate platform, including all software, design, logos, trademarks, and content created by us, is protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute our platform or content
• Use our trademarks or branding without permission
• Create derivative works based on our platform
• Reverse engineer or decompile our software

6. Subscription & Payment Terms

Free Trial

New users receive a 30-day free trial with access to all premium features. No credit card required for the trial period.

Subscription Plans

• Private Pilot: $4.99/month - Essential features for serious pilots
• Commercial Pilot: $9.99/month - All features + priority support (FEATURED)
• Airline Captain: $19.99/month - VIP treatment + unlimited everything

Note: Plans start at just $4.99/month after your free trial ends. All prices are in USD.

Payment Terms

• All fees are in USD unless otherwise stated
• Payment is due at the start of each billing cycle
• Auto-renewal: Subscriptions renew automatically unless cancelled
• We use Stripe for secure payment processing (PCI DSS Level 1)
• All sales are final (no refunds except as required by law)

Cancellation

• You can cancel your subscription at any time from Account Settings
• Cancellation takes effect at the end of your current billing period
• You will retain access to premium features until the subscription expires
• No partial refunds for unused time

7. Safety & Meeting Guidelines

Before Meeting

• ✅ Get to know the person through messages first
• ✅ Video chat before meeting in person
• ✅ Research the person (Google their name, check social media)
• ✅ Tell a friend or family member where you're going and when you'll be back
• ✅ Share your location with a trusted contact

During the Meeting

• ✅ Meet in a public place (airport restaurant, FBO, coffee shop)
• ✅ Provide your own transportation
• ✅ Stay sober and alert
• ✅ Keep your phone charged and with you
• ✅ Trust your instincts - leave if you feel uncomfortable
• ❌ Don't share your home address or personal details immediately
• ❌ Don't get in their aircraft on the first meeting

Flying Together Safety

• Verify the pilot's credentials before flying with them
• Check the aircraft's airworthiness certificate
• Ensure the pilot is current and qualified
• Review weather and flight plan before departure
• Don't fly with someone you just met - build trust first

8. Privacy & Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

9. Disclaimers & Limitations of Liability

Service "As Is"

PilotDate is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

• The service will be uninterrupted or error-free
• You will find a compatible match
• Any information provided by users is accurate
• The service will meet your specific requirements

No Liability for User Conduct

PilotDate is not responsible for the conduct of any user, whether online or offline. You interact with other users at your own risk. We are not liable for:

• Damages arising from interactions with other users
• Personal injury or property damage from in-person meetings
• Financial loss from scams or fraud by other users
• Emotional distress from failed relationships
• Aviation accidents or incidents involving users you meet on the platform

Limitation of Liability

To the maximum extent permitted by law, PilotDate's total liability for any claims arising from your use of the service is limited to the amount you paid for the service in the 12 months preceding the claim (or $100, whichever is greater).

10. Account Termination

Termination by You

You may delete your account at any time from Account Settings. Account deletion is permanent after a 14-day grace period.

Termination by Us

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

• Violation of these Terms of Service
• Violation of our Privacy Policy or Community Guidelines
• Fraudulent, abusive, or illegal activity
• Misrepresentation or fake profile creation
• Non-payment of subscription fees
• Inactivity for more than 2 years
• Any conduct we deem harmful to the platform or community

Effects of Termination

Upon termination:

• Your profile becomes inaccessible to other users
• You lose access to all premium features
• Your data will be deleted within 30 days (subject to legal retention requirements)
• No refund for unused subscription time (unless required by law)
• You may not create a new account without our permission

11. Dispute Resolution & Arbitration

Informal Resolution

If you have a dispute with PilotDate, please contact us at support@pilotdate.com to attempt to resolve the issue informally before pursuing legal action.

Binding Arbitration

If informal resolution fails, you agree that any disputes will be resolved through binding arbitration rather than in court, except for disputes that qualify for small claims court.

• Arbitration will be conducted by the American Arbitration Association (AAA)
• The arbitration will take place in your state of residence or online
• The arbitrator's decision is final and binding
• You waive your right to a jury trial
• You waive your right to participate in a class action lawsuit

Exceptions

The following disputes are NOT subject to arbitration:

• Small claims court disputes
• Intellectual property disputes
• Injunctive relief requests

12. General Provisions

Governing Law

These Terms are governed by the laws of the State of [Your State], USA, without regard to conflict of law provisions.

Changes to Terms

Assignment

You may not assign or transfer these Terms or your account. We may assign our rights and obligations to another company.
